Terms and Conditions

1. Ordering Process

Orders can be placed online directly on the seller’s website by simply adding the goods to the electronic shopping cart.
If the buyer has not found the necessary information about the goods in the product description, they may contact the seller at the email address info@maxtactix.com.
Before submitting the order, the buyer has the option to check and modify all data entered into the order.
Goods ordered via the online store are considered a binding order.
The order also constitutes a proposal for a purchase contract, the conclusion of which does not require confirmation by the seller; the purchase contract is thus concluded by the delivery of the goods.
After submitting the order, the buyer receives an automatic confirmation of its receipt to their email address.
If the ordered goods cannot be delivered, the seller shall inform the buyer of this fact without delay and propose a solution (replacement, modification of the order, or its cancellation).
To process and dispatch the order, all required fields in the order form must be completed.


2. Obligations of the Seller

The seller undertakes to deliver to the buyer:

  1. The type and quantity of goods at the purchase price and under the payment terms valid on the day of order submission.

  2. Goods properly packaged to prevent damage during transport.

  3. Goods in compliance with the applicable laws of the Slovak Republic.

The seller is not liable for circumstances beyond their control, in particular:

  1. Delays in delivery caused by postal or courier services.

  2. Delays in delivery due to an incorrectly stated recipient address.

  3. Damage to the shipment caused by the carrier.


3. Obligations of the Buyer

The buyer undertakes to:

  1. Provide truthful and complete information in the order necessary for its processing.

  2. Accept the ordered goods, check the integrity of the packaging and the contents of the shipment, and immediately report any defects or discrepancies to the seller.

  3. Pay the purchase price of the goods in accordance with the payment terms valid on the day of order submission.

  4. In case the buyer does not accept the goods, the seller reserves the right to claim reimbursement for the costs incurred as a result.

In case of repeated failure to accept deliveries, the seller reserves the right to cancel further orders from the same buyer.


4. Prices of Goods

The prices listed in the online store are valid at the time the order is placed and do not change in case of later price updates.
The published prices are valid only for purchases made in the seller’s online store and may differ from prices in physical retail stores.
All prices are listed including VAT, unless stated otherwise.
The seller reserves the right to correct printing errors and to change prices (for example, due to changes in exchange rates or supplier terms).
The proof of purchase is the receipt included with every shipment, which also serves as the delivery and warranty certificate.
Postage and packaging are added to the price of the goods according to the current delivery price list stated in Section 7.


5. Delivery Conditions

Upon receiving the order, the seller checks its content and the availability of the goods.
If an item is missing or damaged, the seller informs the buyer by email.
After confirmation of the adjusted order, the seller processes it and prepares it for dispatch.
The goods are shipped after completion of the order or after receipt of payment for advance payments.
After the shipment is dispatched, the buyer receives a confirmation along with a tracking link.
The seller undertakes to deliver the goods within 30 calendar days at the latest, unless otherwise agreed.
In the event of delay, the buyer shall be informed and has the right to withdraw from the contract.


6. Delivery Time

Orders received on working days in the morning are usually dispatched on the same day, provided the goods are in stock.
Orders received after this time are processed on the following working day.
During weekends and public holidays, the e-shop does not dispatch parcels.
In the event of complications, the seller reserves the right to postpone the dispatch to the nearest possible date and will inform the buyer accordingly.
After handing over the shipment to the carrier, the responsibility for delivery passes to the carrier.


7. Postage and Shipping

The seller provides delivery through Packeta (pickup points, Z-BOX lockers, or Packeta Home service).

Packeta – Pickup Point or Z-BOX:

  • Price: €4.90

  • Free shipping for orders over €100

  • Delivery: 1–2 working days

Packeta Home:

  • Price: €5.50

  • Free shipping for orders over €100

  • Delivery: next working day

To the Czech Republic:

  • Price: €5.90 (cash on delivery not available)

The buyer is informed of the shipment dispatch by email or SMS.


8. Payment Methods

The seller offers the following payment method:

  1. Card payment via ThePay gateway – a secure and recommended method, free of charge.

The seller is not responsible for outages or malfunctions of the carrier’s payment services.


9. Withdrawal from the Contract

The buyer has the right to withdraw from the contract within 14 days of receiving the goods, without giving any reason.
A notice of withdrawal must be sent by email or by post to the seller’s address.
The goods must be returned within 14 days of the withdrawal.
The seller shall refund all payments within 14 days of receiving the goods or proof of dispatch.
The cost of returning the goods is borne by the buyer.


10. Complaints

The warranty period is 24 months.
The complaint applies to manufacturing defects, not to damage caused by improper use.
The buyer must report a complaint by email and, after agreement, send the goods to the seller’s address without cash on delivery.
Complaints are handled within 30 days from the date the goods are received.


11. Personal Data Protection

The processing of personal data is governed by the General Data Protection Regulation (GDPR) and Act No. 18/2018 Coll. on the protection of personal data.
The seller processes personal data only for the purposes necessary for:

  • processing orders,

  • accounting and tax purposes,

  • handling complaints and customer inquiries,

  • sending commercial communications and newsletters (if the buyer has given consent).

The buyer has the right of access, rectification, erasure, data portability, restriction of processing, and the right to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic.

12. Final Provisions

These Terms and Conditions form an integral part of the purchase contract.
The relationship between the seller and the buyer is governed by the legal system of the Slovak Republic.
The seller reserves the right to amend these Terms and Conditions.
The valid version is published on the e-shop’s website.

13. Alternative Dispute Resolution

If the consumer is not satisfied with the way in which the seller handled their complaint or believes that the seller has violated their rights, the buyer has the right to contact the seller with a request for redress.
If the seller responds to this request with a rejection or does not reply within 30 days from its submission, the consumer has the right to submit a proposal for the initiation of alternative dispute resolution (ADR) pursuant to § 12 of Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes and on the Amendment of Certain Acts, as amended.

The competent authority for alternative dispute resolution with the seller is the Slovak Trade Inspection (contact information available at: https://www.soi.sk/sk/alternativne-riesenie-spotrebitelskych-sporov.soi) or another relevant authorized legal entity listed in the register of ADR entities maintained by the Ministry of Economy of the Slovak Republic (the list is available at https://www.mhsr.sk/ or directly at https://www.mhsr.sk/obchod/ochrana-spotrebitela/alternativne-riesenie-spotrebitelskych-sporov-1/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov-1).

The consumer has the right to choose which ADR entity to contact.
The consumer may also use the online dispute resolution platform (ODR) available at http://ec.europa.eu/consumers/odr/ or directly at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage.

Alternative dispute resolution may only be used by a buyer who acts as a consumer when concluding and performing the contract.
ADR applies only to disputes between a consumer and a seller arising from or related to a consumer contract, and only to contracts concluded at a distance.
An ADR entity may refuse to deal with a case if the quantifiable value of the dispute does not exceed €20.
An ADR entity may charge the consumer a fee for initiating the procedure, up to a maximum of €5 including VAT.
